Contest Terms and Conditions

OFFICIAL RULES: NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

ELIGIBILITY: All individuals who are legal U.S. residents who have reached the age of majority in the State in which they reside, are eligible to participate except employees, members of their households (whether related or not) and their immediate families (spouses, parents, siblings, children and each of their respective spouses), of Private Trade Winds, Inc., its respective subsidiaries, affiliates and anyone involved in the promotion, development and handling of this contest. Including, but not limited to drawing judges and persons domiciled with any of the above. Void outside the United States, in Puerto Rico and where prohibited by law

HOW TO ENTER: There are two (2) ways to enter. One (1) enter online by visiting www.privatetradewinds.com, and going to "Contact us" and completing all of the required information requested on our contact page; or (2) enter by mail by printing your name, address, e-mail address, daytime phone number and the name of the prize drawing (Treasure Chest Giveaway) to: Private Trade Winds, Attention Kristen Schusterick, 500 Newport Center Drive, Suite 500, Newport Beach, CA, 92660. The entry period begins on September 15, 2009 at 12:01 AM Eastern Time ("ET") and will close on December 15, 2009 at 11:59 Eastern Time ("ET"). Mail in entries must be postmarked by December 15, 2009 and all Internet entries must be received on December 15, 2009 at 11:59 Eastern Time ("ET")

PRIZES One (1) Grand prizewinner will be selected in a random drawing, conducted by Private Trade Winds, Inc from along all eligible entries received to be held on or about December 18, 2009 and approximate retail value ("ARV") at $2045.00. The Contest Prize consists of: one (1) Private Trade Winds -Capital Travel Plan (valued at $995) and (1) 3 -night stay in a select property in PGA West, La Quinta, California represented by Private Trade Winds, Inc. Regular departure cleaning is included. (valued at $1050) Additional charges will apply if daily housekeeping is desired. Winner must specify date of travel at time of booking and blackout periods may apply. Winner is responsible for any taxes and/or insurance related to the stay. Confirmation of requested travel date will be given 14 days prior to departure and will be subject to availability at time of booking. Once booked, travel arrangements may not be changed. Traveling companion must be at least the age of majority. The Prizewinner will be responsible for all expenses not specifically stated as part of the Prize, including but not limited to, any applicable taxes, fees, airport charges. Cancellation insurance is not part of the Prize, but is recommended (must be arranged privately by winner). Prize must be accepted as awarded with no substitution. Prize is non-transferable and cannot be redeemed for cash or credit, in whole or in part, for any destination. The approximate retail value of the Prize is US $2045; actual value may vary depending upon winner's selection of travel itineraries: one (1). Any expenses not mentioned above are the winner's responsibility.

WINNER NOTIFICATION AND ACCEPTANCE will be notified on or about December 21,2009. Winner will be notified by e-mail or phone. Getaway Contest, the following steps must be taken: (a) read and agree to the rules and regulations; (b) provide contact information. Incomplete or inaccurate information is void. No other form of entry will be accepted. Any person who attempts to participate under multiple identities, or uses any device or artifice to enter multiple times in violation of the preceding entry limitation will be disqualified. Winners of Prize will be notified three business days after the end of the contest period. Prize is not transferable or redeemable for cash. Taxes are the winner's responsibility. Prize acceptance constitutes permission (except where prohibited) to use winner's name and likeness for advertising and publicity purposes without additional compensation. Sponsor and its agents are not responsible for any liability associated with the acceptance or use of or inability to use a prize.

RELEASE OF LIABILITY: By entering, the entrants agree to hold Private Trade Winds the Sponsor, its subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of a prize in the Contest, or their participation in the Contest, or their participation in any Contest or prize related activity.

GENERAL TERMS: in order to be eligible to win the Prize, winner is required to sign a lease agreement and discharge of liability form acknowledging non-responsibility of Private Trade Winds, Inc. in respect to injuries, accidents, loss, or misfortune relating to the drawing and/or the awarding of the Prize. Place a security deposit for any damages and/or authorize a credit and background check. Failure to comply with all the contest rules or to sign and return any of the release forms will result in disqualification and another random winner will be selected from the entrants in this contest period. A selected player will be declared a winner only after meeting all of the above terms and conditions. The laws of the State of California, USA, shall govern this promotion. The names of the winners may be posted in the "emails" and entrant accepts entry as an opt-in to receive communications by Private Trade Winds, Inc. and/or its partners. By participating, players agree that they have read, understood and agree to these contest rules and regulations and release Private Trade Winds, Inc. from all liability in connection with this contest and/or any Prize. Prize is subject to all applicable Federal, State and Municipal taxes, which are the responsibility of the winner. Private Trade Winds, Inc. reserves the right to amend or terminate all or any portion of this contest at any time without prior notification. Private Trade Winds, Inc. reserves the right to substitute a Prize of equal or greater value in the event of non-availability of the Prize for any reason. Void where prohibited.
